Partner visa sponsor statutory declaration (801)

Short answer

At stage 2 of an onshore partner visa (subclass 801), Home Affairs asks for a Commonwealth statutory declaration completed by the sponsor about the relationship. The sponsor can make it digitally through myGov without a witness, or on the approved paper form signed in front of an approved witness, in person or by video link.

It is a different document from the 2 Form 888 witness statements, which the 801 stage also asks for.

What does the 801 sponsor statutory declaration cover?

The 801 page asks for the sponsor’s declaration to give information about any of the following:

  • whether you and your partner have a mutual commitment, to the exclusion of all others
  • whether the relationship is genuine and continuing
  • whether you live together or don't live permanently apart
  • when the relationship began and how long you have lived together
  • the financial commitments you share
  • the nature of your household, including any joint responsibility for the care and support of children
  • the social aspects of the relationship
  • the nature of your commitment to each other
  • your plans for the future

These are the topics Home Affairs names. What the sponsor says about each one is theirs to write; we don’t suggest content, and the Attorney-General’s Department says it can’t either: questions about content go to whoever asked for the declaration.

How does the sponsor make a Commonwealth statutory declaration?

The Attorney-General’s Department lists three ways, all equally valid:

  1. Digital, through myGov with a Digital ID. No witness is needed.
  2. The approved form, signed in person while an approved witness watches.
  3. The approved form, signed by video link (such as Zoom, Teams or FaceTime) while an approved witness watches remotely.

Who can be an approved witness is set out on the Attorney-General’s “Information for witnesses” page. Making a false statement on purpose in a statutory declaration is an offence.

When and where does it go?

With the other stage 2 documents, attached in ImmiAccount. Home Affairs considers the permanent visa two years after you applied and says not to send the documents before then. The full list is on the 801 checklist.

Are statutory declarations used at stage 1 too?

Sometimes. Separately, the subclass 820 page asks applicants who don't hold a substantive visa for at least two Commonwealth statutory declarations, and says current and previous versions of Form 888 don't satisfy that requirement. That requirement and Form 888 are explained on Is Form 888 a statutory declaration?

What about the Form 888 statements at stage 2?

The 801 page also asks for statements from 2 witnesses on Form 888, as part of your updated relationship evidence. Our Form 888 tool sends each witness a private link; they answer in their own words and your browser fills in the official form.

Questions

What is the sponsor statutory declaration for a partner visa?

At stage 2 (subclass 801), Home Affairs asks you to attach a Commonwealth statutory declaration completed by the sponsor, with information about the relationship, such as whether it is genuine and continuing, whether you live together, your finances, household, social life, commitment and plans for the future.

Which statutory declaration form does the sponsor use?

The 801 page asks for a Commonwealth statutory declaration, not a state or territory one. The Attorney-General's Department publishes the approved form and runs the digital version through myGov.

Does the sponsor's statutory declaration need a witness?

A paper one does: it is signed while an approved witness watches, in person or by video link. A digital Commonwealth statutory declaration made through myGov with a Digital ID needs no witness. The Attorney-General's Department says all three are equally valid.

Is Form 888 a statutory declaration?

No. Since July 2023, Form 888 has been a supporting statement, not a statutory declaration: it has no JP or qualified-person witness and no “declared at” section. The sponsor's declaration and the 2 Form 888 witness statements are separate documents, and the 801 page asks for both.

Can you write the statutory declaration for us?

No. A statutory declaration is the sponsor's own account of facts they declare true. We don't write or suggest relationship content, and we don't give migration advice. The Attorney-General's Department also says it can't advise on what to write.
